Terms of Service

These Terms of Service ("Terms") govern your use of Second Look and any related services operated by Orchard Foundry LLC ("we," "us," or "our"). By downloading or using the app, you agree to these Terms. If you don't agree, don't use the app.

1. What Second Look does

Second Look is a live replay recorder that maintains a local video buffer on your device. You can scrub back through that buffer, drop markers, and cut clips — while recording continues in the background. Everything it captures stays on your device unless you choose to export it.

Second Look is local-first. By default, your recordings stay on your device and are never transmitted to us. Any future cloud features will be clearly described and opt-in.

2. Your account and subscription

Some features require a paid subscription. To activate your subscription across multiple devices, we collect only what we need: your email address, your subscription status, and a device identifier. We use this solely to verify your entitlement and to improve the app.

You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your account with others or allow use by more people than your subscription covers.

Second Look, its design, code, trademarks, and all associated content are owned by Orchard Foundry LLC and protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the app as described here.

Your recordings belong to you. We make no claim to any content you create with the app.

5. Subscription billing and cancellation

Subscriptions are billed on a recurring basis through the platform you purchased through — Apple App Store or Google Play. We do not store your payment information. Cancellation takes effect at the end of your current billing period — you retain access until then. Refunds are governed by the applicable platform's refund policy (Apple App Store or Google Play).

6. Disclaimer of warranties

Second Look is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be error-free, uninterrupted, or fit for any particular purpose. Use it at your own risk.

We are not responsible for any lost recordings caused by device failure, software bugs, storage limits, or any other reason. Always back up footage that matters to you.

7. Limitation of liability

To the maximum extent permitted by applicable law, Orchard Foundry LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — Second Look, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

8. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you through the app or by email. Continued use after the effective date of updated Terms constitutes acceptance. If you don't agree to the updated Terms, stop using the app and cancel your subscription.

9. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in San Francisco County, California.
